1. Acceptance of Terms

Welcome to Duvelle ("duvelle.in", the "Site", "Platform", or "Store"), an online luxury menswear portal owned and operated by Republic of Clothing("Duvelle", "we", "us", or "our"), having its registered office at B2-706, Boomerang Co-op, Chandivali Farm Rd, Andheri East, Mumbai — 400072, Maharashtra, India.

These Terms & Conditions, together with our Privacy Policy and Shipping & Returns Policy, form a legally binding contract between you ("User", "Customer", "You") and Republic of Clothing.

By accessing, browsing, registering an account, or purchasing any garments through Duvelle, you acknowledge that you have read, understood, and agreed to be bound by all terms, conditions, and notices contained herein. If you do not accept these terms in full, please refrain from using our services.

2. Eligibility & Account Security

Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872:

• Age Requirement: You must be at least 18 years of age. If you are under 18, you may use Duvelle only under the active supervision of a parent or legal guardian who agrees to be bound by these terms.
• Account Confidentiality: When registering, you agree to provide authentic, current, and complete details. You are solely responsible for maintaining the confidentiality of your account credentials, login passwords, and OTPs.
• Account Activity: You assume full legal responsibility for all orders, activities, and transactions occurring under your authenticated profile. If you suspect unauthorized access, notify our concierge immediately at hello@duvelle.in.
• Suspension Rights: Duvelle reserves the right to refuse service, suspend accounts, or cancel orders at its discretion if false information is supplied or fraudulent activity is detected.

3. Product Accuracy, Color Representation & Sizing

Duvelle takes immense pride in our tailoring, fabric curation, and artisan finishes. We strive to present our garments as truthfully and vividly as possible:

• Color Accuracy: We photograph garments in studio lighting to accurately depict true-to-life tones. However, because display monitors and mobile screens render RGB gamuts differently, actual fabric hues may exhibit subtle variations from what appears on your specific device.
• Fabric & Weave: Minor natural variations in weave texture, knit tension, or bespoke dye lots are standard characteristics of premium natural textiles (such as Egyptian cotton, linen blends, and merino wool) and do not constitute manufacturing flaws.
• Sizing & Measurement Guides: Detailed size charts (chest, shoulder, sleeve length, waist, inseam) are published for every garment. Standard textile manufacturing tolerances of up to ±0.5 inches are accepted industry standards.

4. Pricing, Statutory GST & Invoicing

Our pricing structure is clear, honest, and free of hidden fees:

• Currency & GST: All prices on Duvelle are listed in Indian National Rupees (INR ₹) and are fully inclusive of statutory Goods and Services Tax (GST) as applicable under Indian taxation laws.
• Invoice Issuance: A compliant GST tax invoice detailing product HSN codes, IGST/CGST/SGST breakdowns, and our registered GSTIN will be sent digitally and enclosed within your physical parcel.
• Price Adjustments: Duvelle reserves the right to modify prices, launch promotional flash discounts, or withdraw discounts at any time without prior notice. Price alterations will not affect orders that have already received confirmed dispatch status.
• Typographical / Pricing Errors: In the rare event an item is erroneously listed at an incorrect price due to technical glitches or clerical slips, Duvelle reserves the right to cancel the order and provide an immediate 100% refund to the original payment source.

5. Orders, Acceptance & Contract Formation

Placing an order on Duvelle constitutes an offer by you to purchase the selected items:

• Order Acknowledgment: When you complete checkout, you will receive an automated confirmation email/SMS/WhatsApp summarizing your order details. This acknowledgment verifies receipt of your request but does not constitute formal acceptance of your purchase offer.
• Order Acceptance: Acceptance of your order and the completion of the sales contract between Duvelle and you occurs when the ordered garments are quality-audited, steam-pressed, and handed over to our courier partner with an assigned consignment tracking number.
• Commercial Quantities / Bulk Reselling: Duvelle is a direct-to-consumer brand. We strictly prohibit unauthorized commercial reselling. We reserve the right to decline or cancel orders with bulk quantities placed by single accounts or shipping to known freight forwarders without written wholesale authorization.
• Inventory Constraints: In rare cases where a garment is discovered to be out of stock during quality inspection, you will be notified immediately and provided an instant 100% refund.

6. Shipping, Delivery Timelines & Risk of Loss

We ship across India in partnership with India’s leading air and surface express logistics networks (BlueDart, Delhivery, Xpressbees, DTDC):

• Shipping Rates:
  • Orders valued at ₹499 and above receive Complimentary Free Shipping across India.
  • Orders below ₹499 incur a flat nominal shipping fee of ₹50.
• Dispatch Timelines: In-stock orders are quality-checked and dispatched within 24 to 48 hours of placement (excluding national holidays and Sundays).
• Estimated Delivery Periods:
  • Metro Cities (Mumbai, Delhi NCR, Bengaluru, Hyderabad, Chennai, Kolkata): 2 to 4 business days.
  • Tier 2 & Tier 3 Cities: 3 to 6 business days.
  • Rest of India & Special Postal Areas: 5 to 8 business days.
• Transfer of Risk: Title and risk of loss for items pass to you upon delivery to the designated shipping address, confirmed via courier signature, OTP, or automated delivery scan.
• Non-Delivery / Incorrect Address: Customers are responsible for providing precise postal addresses and phone numbers. In cases where shipments return to origin (RTO) due to repeated customer unavailability or invalid addresses, re-shipment charges may apply.

7. Payment Methods, Gateway Security & COD Rules

We support a wide array of frictionless digital payment methods:

• Prepaid Payment Modes:UPI (Google Pay, PhonePe, Paytm, CRED), Credit & Debit Cards (Visa, MasterCard, RuPay, American Express), and Net Banking across all premier Indian banks.
• Bank-Grade Encryption: All prepaid transactions are processed via PCI-DSS Level 1 certified gateways (such as Razorpay). Duvelle never stores sensitive CVVs, card numbers, or UPI PINs.
• Cash on Delivery (COD):
  • COD is available for serviceable PIN codes across India on orders within designated cart limits.
  • COD orders may be subject to automated phone or WhatsApp confirmation prior to dispatch.
  • Duvelle reserves the right to disable COD payment options for accounts with high Return-to-Origin (RTO) rates or repeated delivery refusals.

8. 7-Day Hassle-Free Returns & Size Exchanges

We stand behind the craftsmanship of every piece. If the fit or style is not entirely satisfactory, we offer a straightforward resolution:

• Eligible Conditions: Garments must be in pristine, unworn, unwashed, and odor-free condition, with all original tags, designer collar stays, spare buttons, and brand packaging intact.
• Non-Returnable Items (Hygiene Policy): For strict hygiene reasons, innerwear, undershirts, briefs, socks, and custom-monogrammed pieces are strictly non-returnable and non-exchangeable, unless delivered in a damaged or defective condition.
• Doorstep Reverse Pickup: Once approved, our courier partner arranges a pickup at your doorstep at no additional charge.
• Refund Processing:
  • Prepaid orders: Refunded to the original payment source (bank account/card/UPI) within 5 to 7 business days of warehouse quality inspection.
  • COD orders: Refunded via secure NEFT/IMPS bank transfer or instant Duvelle Store Credit, according to customer preference upon submitting bank details.

9. Order Cancellations & Modifications

• Cancellation Prior to Dispatch: You may cancel any order free of charge before the item has been packed and handed over to logistics. Simply email hello@duvelle.in or message our WhatsApp concierge with your Order ID.
• Post-Dispatch Cancellations: Once dispatched from our fulfillment facility, orders cannot be cancelled in transit. You may accept the delivery and initiate a standard 7-day exchange or return.
• Duvelle Cancellation Rights: We reserve the right to cancel orders due to non-availability of stock, suspected fraudulent transactions, or unserviceable delivery locations. Any payments charged will be refunded in full immediately.

10. Promotional Codes, Coupons & Store Credit

• Validity & Terms: Promotional coupon codes, welcome discounts, and seasonal offers are valid for specified timeframes and criteria only.
• Non-Stackable: Promotional coupon codes cannot be combined, stacked, or used in conjunction with other vouchers unless explicitly stated.
• No Cash Surrender Value: Coupons and promotional credits carry no cash value and cannot be exchanged for cash or transferred between accounts.
• Refunds on Discounted Orders: In the event of a partial or complete return of an order purchased with a coupon, the refunded amount will reflect the net amount actually paid.

11. Intellectual Property Rights

The Duvelle platform, its visual identity, and its collections are protected under Indian and international intellectual property laws:

• Proprietary Ownership: All trademarks, logos, brand names, garment designs, photographic assets, video lookbooks, copy, graphical icons, UI designs, and underlying source code belong exclusively to Republic of Clothing.
• Limited License: You are granted a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial shopping purposes.
• Strict Prohibitions: Any unauthorized reproduction, downloading, scraping, decompiling, framing, republishing, or commercial exploitation of Duvelle assets without express prior written consent is strictly prohibited and constitutes actionable intellectual property infringement.

12. Prohibited Activities & User Conduct

When utilizing Duvelle, you agree not to engage in any of the following prohibited behaviors:

• Violating any local, state, national, or international statute, law, or regulation.
• Deploying automated robots, spiders, scrapers, or scripts to extract site data or bypass rate limits.
• Attempting to probe, scan, or breach platform security, firewalls, or authentication mechanisms.
• Placing false, speculative, or fictitious orders or abusing Cash on Delivery privileges.
• Submitting defamatory, obscene, harassing, or abusive communications to our customer concierge staff.
• Reverse engineering or tampering with website checkout or payment gateways.

13. Disclaimer of Warranties & Limitation of Liability

Duvelle and its services are provided on an "AS IS" and "AS AVAILABLE" basis:

• No Express Warranties: While we endeavor to ensure maximum uptime, accurate descriptions, and flawless site operation, we do not warrant that our platform will be entirely uninterrupted, error-free, or devoid of minor technical delays.
• Force Majeure: Duvelle and Republic of Clothing shall not be held liable for failure or delay in fulfilling orders or deliveries due to acts beyond our reasonable control, including natural disasters, extreme weather events, pandemic restrictions, labor strikes, airport closures, civil unrest, or telecommunication failures.
• Monetary Liability Cap: To the maximum extent permitted by applicable Indian law, the total aggregate liability of Republic of Clothing and Duvelle for any claim arising out of or related to these Terms or any product purchase shall be strictly capped at the actual price paid by you for the specific garment or product giving rise to the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless Duvelle, Republic of Clothing, its directors, officers, employees, partners, and contractors from and against any third-party claims, liabilities, losses, damages, demands, and expenses (including reasonable attorney fees) arising from: (a) your breach of these Terms & Conditions; (b) your violation of any applicable law; or (c) your infringement of any third-party rights, including intellectual property or privacy rights.

15. Governing Law & Exclusive Jurisdiction

These Terms and Conditions, your relationship with Duvelle, and all contractual obligations arising out of sales shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India, without regard to conflict of law principles.

In the event of any legal dispute, difference, or claim arising out of or relating to your use of this platform or purchases made herein, the parties agree that the competent civil courts located in Mumbai, Maharashtra, India shall have exclusive legal jurisdiction.

16. Consumer Grievance Redressal & Nodal Desk
